PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING OUR WEBSITE, SUBMITTING ANY FORM, OR ENGAGING WITH ANY LICENSED AGENT OF POWER FINANCIAL GROUP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS IN THEIR ENTIRETY.

Section 1: Identification of the Parties

These Terms of Service ("Agreement" or "Terms") constitute a legally binding contract between you ("User," "Client," "Visitor," or "Prospect") and PWR FIN LLC dba Power Financial Group ("Company," "we," "us," or "our"), an independent insurance agency duly organized and licensed to operate across the United States of America.

PWR FIN LLC dba Power Financial operates as an independent agency and is not a captive agent of any single insurance carrier. All products are offered through licensed and appointed insurance carriers authorized to conduct business in applicable states.

Section 2: Scope of Services

PWR FIN LLC dba Power Financial Group provides the following services to consumers:

  1. 1 Final Expense Insurance

We offer final expense life insurance products designed to cover end-of-life expenses including funeral costs, burial or cremation services, outstanding medical bills, and related expenses. Coverage amounts typically range from $5,000 to $35,000. These are whole life insurance products with guaranteed level premiums and a guaranteed death benefit, subject to the terms and conditions of the individual policy issued by the applicable carrier.

  1. 2 Indexed Universal Life (IUL) Insurance

We offer Indexed Universal Life insurance products, which are permanent life insurance policies with a cash value component that may be linked to the performance of one or more market indices, including but not limited to the S&P 500. IUL products offer a guaranteed minimum interest rate ("floor") that protects cash value from direct market losses, as well as a cap on credited interest. Policy performance illustrations are hypothetical and not guaranteed. All guarantees are subject to the claims-paying ability of the issuing carrier.

  1. 3 Annuities and Other Financial Products

We may offer fixed annuities, fixed indexed annuities, and other insurance-based financial products designed to provide guaranteed income streams and asset protection. These products are insurance contracts, not securities, and are not subject to Securities and Exchange Commission (SEC) oversight unless specifically noted.

  1. 4 Lead Generation and Consultation Services

Our digital platforms, including websites and landing pages, are designed to facilitate the connection between prospective clients and licensed insurance agents. By submitting information through any form on our platforms, you are requesting to be contacted by a licensed insurance professional.

NOTHING ON THIS WEBSITE OR IN ANY COMMUNICATION FROM POWER FINANCIAL GROUP CONSTITUTES LEGAL, TAX, INVESTMENT, OR FINANCIAL PLANNING ADVICE. CONSULT A QUALIFIED PROFESSIONAL BEFORE MAKING ANY FINANCIAL DECISION.

Section 3: Eligibility and User Representations

By using our services, you represent and warrant that:

You are at least 18 years of age or the age of majority in your state or jurisdiction of residence, whichever is greater.

You have the legal capacity to enter into binding agreements under applicable law.

All information you provide to us is accurate, current, and complete.

You are a resident of the United States of America.

You are not currently subject to any court order or legal disability that would prevent you from entering into this Agreement.

You understand that insurance products are subject to eligibility requirements, underwriting approval, and state-specific availability.

PWR FIN LLC dba Power Financial Group reserves the right to refuse service to any individual for any lawful reason, including but not limited to inability to verify identity, prior fraudulent activity, or ineligibility for the requested products.

Section 4: Consent to Contact — TCPA Compliance

  1. 1 One-to-One Consent Requirement

In compliance with the Telephone Consumer Protection Act (TCPA), as amended by the Federal Communications Commission (FCC) effective January 27, 2025, PWR FIN LLC dba Power Financial Group obtains individual, specific written consent from each consumer before initiating any telemarketing call, automated text message, or pre-recorded voice message. We do not rely on general or blanket consent forms that purport to authorize multiple unaffiliated companies.

  1. 2 Nature of Consent

By submitting any form on our platforms, you expressly consent to:

Receiving calls, text messages, and emails from PWR FIN LLC dba Power Financial Group and its licensed agents at the phone number and email address you provide.

Contact may be made using manual dialing, automated dialing, pre-recorded messages, or artificial voice messages.

Contact may occur even if your number is listed on a federal, state, or local Do Not Call registry.

Message and data rates may apply. Message frequency varies based on your inquiry.

  1. 3 Right to Revoke Consent

You may revoke your consent to receive communications at any time by any reasonable means, including:

Replying STOP to any text message

Sending an email to our contact address requesting removal

Verbally requesting removal during any phone call

Submitting a written revocation request to our business address

We will process revocation requests within a reasonable time not to exceed ten (10) business days. Some communications, such as those required for policy servicing or legal compliance, may continue after revocation of marketing consent.

Our consent practices comply with the FCC's January 2025 one-to-one consent rule, the TCPA, the CAN-SPAM Act, and applicable state telemarketing laws.

Section 5: Licensing and Regulatory Compliance

PWR FIN LLC dba Power Financial Group operates through licensed insurance agents who hold active state insurance licenses in each state where they conduct business. Insurance products are offered only through carriers licensed and authorized in the applicable state of the consumer.

All agents affiliated with Power Financial Group are required to:

Hold valid insurance licenses in all states where they solicit, negotiate, or sell insurance products.

Comply with all applicable state insurance codes, regulations, and Department of Insurance guidelines.

Complete continuing education requirements as mandated by their state of licensure.

Adhere to all carrier appointment requirements.

Comply with the National Association of Insurance Commissioners (NAIC) model regulations where applicable.

  1. 1 Texas Insurance Code Compliance

PWR FIN LLC dba Power Financial Group complies with the insurance codes, administrative codes, and regulations of every state in which its affiliated agents are licensed. This includes but is not limited to the Texas Insurance Code and Texas Administrative Code Title 28 (for Texas operations). Consumers with complaints may contact the Department of Insurance in their state of residence. Texas consumers may contact the TDI at www.tdi.texas.gov or 1-800-252-3439.

  1. 2 Multi-State Operations

To the extent agents affiliated with Power Financial Group are licensed in states other than Texas, they comply with all applicable laws of such states, including but not limited to state-specific suitability requirements, replacement regulations, and disclosure mandates.

Section 6: Suitability and Fiduciary Acknowledgment

PWR FIN LLC dba Power Financial Group and its affiliated agents are committed to recommending only products that are suitable for each client's individual financial situation, needs, goals, and risk tolerance. In making suitability determinations, agents consider:

The client's age and health status

Current financial situation and income

Existing insurance coverage and financial assets

Stated financial goals and time horizon

Risk tolerance and investment experience (for IUL products)

Family circumstances and estate planning objectives

While affiliated agents act with professionalism and care, PWR FIN LLC dba Power Financial Group is an independent insurance agency and does not hold itself out as a registered investment advisor, securities broker-dealer, or fiduciary under the Employee Retirement Income Security Act (ERISA) unless specifically disclosed. Insurance agents are not required to act as fiduciaries under current insurance regulations unless acting in a capacity subject to applicable state fiduciary rules.

Section 7: Disclaimers and Limitations

  1. 1 No Guarantee of Coverage

Submission of information through our platforms does not constitute an application for insurance, a binding contract, or a guarantee of coverage. All insurance applications are subject to underwriting approval by the issuing carrier. Power Financial Group makes no representation that any individual will qualify for any specific product, rate, or benefit.

  1. 2 Illustration Disclaimers

Any policy illustrations, projections, or hypothetical examples provided are for educational purposes only and do not represent guaranteed future results. IUL policy cash value accumulation is subject to cap rates, participation rates, floors, policy charges, mortality costs, and index performance — all of which may change over time in accordance with policy terms.

  1. 3 Third-Party Carriers

PWR FIN LLC dba Power Financial Group does not issue insurance policies. All policies are issued by independent, licensed insurance carriers. The financial strength, claims-paying ability, and continued availability of products depend on the issuing carrier, not Power Financial Group. Power Financial Group is not liable for the acts, omissions, insolvency, or failure of any carrier.

Information provided on our websites and platforms is for general informational and educational purposes only. It does not constitute legal, tax, accounting, financial planning, or investment advice. We make no representations regarding the completeness, accuracy, or timeliness of any information on our platforms.

Section 8: Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POWER FINANCIAL GROUP, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND AFFILIATED CARRIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO:

Loss of income or profits

Loss of business or economic opportunity

Loss of data or personally identifiable information

Policy lapse, cancellation, or non-renewal by any carrier

Errors or omissions in policy recommendations

Unauthorized access to your submitted information

IN NO EVENT SHALL PWR FIN LLC dba Power Financial Group'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT OF PREMIUMS PAID BY YOU IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR $1,000.00, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

Section 9: Intellectual Property

All content on PWR FIN LLC dba Power Financial Group's websites and platforms, including but not limited to text, graphics, logos, page designs, landing pages, form layouts, marketing copy, and software code, is the exclusive intellectual property of Power Financial Group or its licensors and is protected by United States and international copyright, trademark, and trade secret laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our platforms for personal, non-commercial purposes only. You may not:

Reproduce, copy, or distribute any content without prior written consent

Use our content for commercial purposes or competitive intelligence

Reverse engineer, scrape, or systematically extract data from our platforms

Remove or alter any copyright, trademark, or proprietary notices

Section 10: Indemnification

You agree to indemnify, defend, and hold harmless Power Financial Group and its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

Your violation of these Terms

Your use or misuse of our platforms or services

Your submission of false, inaccurate, or misleading information

Your violation of any applicable law, regulation, or third-party right

Any claim that your conduct caused damage to a third party

Section 11: Dispute Resolution and Arbitration

  1. 1 Mandatory Arbitration

EXCEPT AS PROVIDED BELOW, ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE BREACH THEREOF, OR YOUR USE OF OUR SERVICES SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) UNDER ITS COMMERCIAL ARBITRATION RULES, RATHER THAN IN COURT.

  1. 2 Class Action Waiver

YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING OF ANY KIND AGAINST POWER FINANCIAL GROUP.

  1. 3 Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent unauthorized use of intellectual property or to protect confidential information. Small claims court actions within applicable jurisdictional limits are also excluded from mandatory arbitration.

  1. 4 Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the United States of America and, to the extent applicable, the laws of the state in which the insurance transaction or service was primarily conducted. To the extent any dispute is not subject to arbitration, you consent to exclusive jurisdiction in the state and federal courts of competent jurisdiction in the applicable state, with Texas serving as the default venue for disputes not clearly arising in another state.

Section 12: Anti-Fraud and Misrepresentation

Power Financial Group takes insurance fraud and material misrepresentation seriously. Any individual who knowingly and willfully provides false information in connection with an insurance application, or who assists in the preparation of a fraudulent application, may be subject to:

Denial of coverage or policy rescission by the issuing carrier

Civil liability under applicable state and federal law

Criminal prosecution under applicable insurance fraud statutes

Referral to the applicable state Department of Insurance fraud division

PWR FIN LLC dba Power Financial Group reserves the right to report suspected fraud to appropriate law enforcement and regulatory authorities without prior notice.

Section 13: Modifications to Terms

PWR FIN LLC dba Power Financial Group reserves the right to modify, update, or replace these Terms at any time in its sole discretion. Material changes will be communicated through one or more of the following methods:

Posting of revised Terms on our website with an updated Effective Date

Email notification to clients with active relationships

Notice at the point of lead submission on our platforms

Your continued use of our services after the posting of revised Terms constitutes your acceptance of those revised Terms. If you do not agree to the revised Terms, you must discontinue use of our services immediately.

Section 14: Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy and any applicable carrier disclosures, constitute the entire agreement between you and Power Financial Group with respect to your use of our services and supersede all prior and contemporaneous agreements, representations, and understandings.

ACKNOWLEDGMENT AND ACCEPTANCE

By accessing our platforms or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service in their entirety.
