TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PWRFIN LLC AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PWRFIN’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF:
(A) THE AMOUNT YOU PAID DIRECTLY TO PWRFIN FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
(B) ONE HUNDRED U.S. DOLLARS (US $100).
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.
22. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless PWRFIN LLC and its owners, officers, directors, employees, agents, representatives, contractors, affiliates, and service providers from and against claims, liabilities, damages, losses, costs, and expenses—including reasonable attorneys’ fees—arising out of or relating to:
- Your violation of these Terms;
- Your misuse of the Services;
